Collection and Use of Your Information
We collect personal information when you subscribe to our email list, purchase products through our website, or register to participate in an online forum or community. Please contact us with any questions, comments, or suggestions.
When you subscribe to one of our publications or services, we may ask you to provide your name and e-mail address and credit card or other payment information in order to fulfill your subscription, send you invoices, and contact you about the expiration of your subscription. Exchanges and Refunds
You can return purchased goods, along with your receipt, within 14 days of receiving them. Please note, subscriptions and digital products are non-refundable. Returned items must be unused, in a saleable condition and include all original packaging. Should a product be subject to further conditions relating to its eligibility for a refund or exchange it will be advertised accordingly. Refunds will be issued to your original payment method. This does not affect your statutory rights.
When you register on our site, you agree to the use of personal information such as your name and e-mail address to be used to deliver the services requested. We collect the information we need to identify who you are, to provide you with the service or information you requested, and/or to facilitate your participation in a forum or online community. Our newsletters may include advertising or marketing messages from carefully selected partners that may be of interest to you.

Prices of all Services, including but not limited to monthly subscription plan fees to the Service, are subject to change upon 30 days notice from us. Such notice may be provided at any time by posting the changes to the Rubric Site (type.fans) or the Service itself.
Rubric shall not be liable to you or to any third party for any modification, price change, suspension or discontinuance of the Service.
Rubric may deliver notice to you by means of e-mail, a general notice on the site, or by other reliable method to the address you have provided to Rubric.
Copyright and Content Ownership
All content posted on the Service must comply with U.S. copyright law. Please review our copyright compliance policy.
We claim no intellectual property rights over the material you provide to the Service. Your profile and materials uploaded remain yours.
Rubric does not pre-screen Content, but Rubric and its designee have the right (but not the obligation) in their sole discretion to refuse or remove any Content that is available via the Service.

Limitation of Liability

Applicable law may not allow the limitation of exclusion of liability or incidental or consequential damages, so the above limitation or exclusion may not apply to you.
In the event that an Rubric product is mistakenly listed at an incorrect price, Rubric reserves the right to refuse or cancel any orders placed for product listed at the incorrect price. Rubric reserves the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is cancelled, Rubric shall issue a credit to your credit card account in the amount of the incorrect price.
Your use of the Service is at your sole risk. The service is provided on an “as is” and “as available” basis.
Technical support is only provided to paying account holders and is only available via email.
You understand that Rubric uses third party vendors and hosting partners to provide the necessary hardware, software, networking, storage, and related technology required to run the Service.
You must not modify, adapt or hack the Service or modify another website so as to falsely imply that it is associated with the Service, Rubric, or any other Rubric (type.fans) service.
You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service without the express written permission by Rubric.
We may, but have no obligation to, remove Content and Accounts containing Content that we determine in our sole discretion are unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene or otherwise objectionable or violates any party’s intellectual property or these Terms of Service.
Verbal, physical, written or other abuse (including threats of abuse or retribution) of any Rubric customer, employee, member, or officer will result in immediate account termination.
You understand that the technical processing and transmission of the Service, including your Content, may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices.
You must not upload, post, host, or transmit unsolicited email, SMSs, or “spam” messages.
You must not transmit any worms or viruses or any code of a destructive nature.
If your bandwidth usage exceeds the limits of your paid subscription, or significantly exceeds the average bandwidth usage (as determined solely by Rubric) of other type.fans customers, we reserve the right to immediately disable your account or throttle delivery of the service until you can reduce your bandwidth consumption or upgrade your account.
Rubric does not warrant that (i) the service will meet your specific requirements, (ii) the service will be uninterrupted, timely, secure, or error-free, (iii) the results that may be obtained from the use of the service will be accurate or reliable, (iv) the quality of any products, services, information, or other material purchased or obtained by you through the service will meet your expectations, and (v) any errors in the Service will be corrected.
You expressly understand and agree that Rubric shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if Rubric has been advised of the possibility of such damages), resulting from: (i) the use or the inability to use the service; (ii) the cost of procurement of substitute goods and services resulting from any goods, data, information or services purchased or obtained or messages received or transactions entered into through or from the service; (iii) unauthorized access to or alteration of your transmissions or data; (iv) statements or conduct of any third party on the service; (v) or any other matter relating to the service.
The failure of Rubric to exercise or enforce any right or provision of the Terms of Service shall not constitute a waiver of such right or provision. The Terms of Service constitutes the entire agreement between you and Rubric and govern your use of the Service, superseding any prior agreements between you and Rubric (including, but not limited to, any prior versions of the Terms of Service).

Your use of this site shall be governed in all respects by the laws of the state of Georgia, U.S.A., without regard to choice of law provisions, and not by the 1980 U.N. Convention on contracts for the international sale of goods. You agree that jurisdiction over and venue in any legal proceeding directly or indirectly arising out of or relating to this site (including but not limited to the purchase of Rubric products) shall be in the state or federal courts located in Dekalb County, Georgia. Any cause of action or claim you may have with respect to the site (including but not limited to the purchase of Rubric products) must be commenced within one (1) year after the claim or cause of action arises. Rubric’s failure to insist upon or enforce strict performance of any provision of these terms and conditions shall not be construed as a waiver of any provision or right. Neither the course of conduct between the parties nor trade practice shall act to modify any of these terms and conditions. Rubric may assign its rights and duties under this Agreement to
any party at any time without notice to you.
Use of Site
Harassment in any manner or form on the site, including via e-mail, chat, or by use of obscene or abusive language, is strictly forbidden. Impersonation of others, including an Rubric or other licensed employee, host, or representative, as well as other members or visitors on the site is prohibited. You may not upload to, distribute, or otherwise publish through the site any content which is libelous, defamatory, obscene, threatening, invasive of privacy or publicity rights, abusive, illegal, or otherwise objectionable which may constitute or encourage a criminal offense, violate the rights of any party or which may otherwise give rise to liability or violate any law. You may not upload commercial content on the site or use the site to solicit others to join or become members of any other commercial online service or other organization.
Rubric does not and cannot review all communications and materials posted to or created by users accessing the site, and is not in any manner responsible for the content of these communications and materials. You acknowledge that by providing you with the ability to view and distribute user-generated content on the site, Rubric is merely acting as a passive conduit for such distribution and is not undertaking any obligation or liability relating to any contents or activities on the site. However, Rubric reserves the right to block or remove communications or materials that it determines to be (a) abusive, defamatory, or obscene, (b) fraudulent, deceptive, or misleading, (c) in violation of a copyright, trademark or; other intellectual property right of another or (d) offensive or otherwise unacceptable to Rubric in its sole discretion.
You agree to indemnify, defend, and hold harmless Rubric, its officers, directors, employees, agents, licensors and suppliers (collectively the “Service Providers”) from and against all losses, expenses, damages and costs, including reasonable attorneys’ fees, resulting from any violation of these terms and conditions or any activity related to your account (including negligent or wrongful conduct) by you or any other person accessing the site using your Internet account.
In an attempt to provide increased value to our visitors, Rubric may link to sites operated by third parties. However, even if the third party is affiliated with Rubric, Rubric has no control over these linked sites, all of which have separate privacy and data collection practices, independent of Rubric. These linked sites are only for your convenience and therefore you access them at your own risk. Nonetheless, Rubric seeks to protect the integrity of its web site and the links placed upon it and therefore requests any feedback on not only its own site, but for sites it links to as well (including if a specific link does not work).
